Article 1. Definitions and applicability
1.1 On all offers, orders and agreements of Bricks 86’s products, these Terms and Conditions (hereafter: Conditions) apply. Unless Bricks 86 in writing agrees with other conditions. From any deviations agreed, the customer cannot derive rights for future transactions.
1.2 The acceptance of an offer or the placing of an order implies that the applicability of these conditions is accepted.
1.3 Exceptions from these conditions can only be made in writing by Bricks 86 in which case the other provisions shall remain in force.

Article 2. Offers / agreements
2.1 Offers from Bricks 86 are non binding. Bricks 86 reserves the right to change prices, especially when necessary on the basis of (legal) requirements.
2.2 An agreement is only complete after acceptance of the order by Bricks 86. Bricks 86 is entitled to refuse orders or certain conditions to the delivery, unless otherwise specified. If an order is not accepted, Bricks 86 will inform the customer within two (2) business days after receipt of the order.

Article 3. Prices and Payment
3.1 The listed prices for the products and services are in EURO and including VAT.
3.2. For customers from countries other than the Netherlands the shipping costs depend on the destination country. Payment can be done online through: PayPal, Credit Card (Visa, Mastercard), “iDEAL” or, after our prior consent by e-mail, by Bank Transfer. For these (online) payments no extra charges are made.

Article 4. Delivery and shipping
4.1 We ship all orders within 2 business days after receipt of payment. Shipping is done by PostNL (Dutch Royal Mail) to the address indicated on your order confirmation. For Germany DHL is the shipping company. Should we not be able to ship the next business day, the client will be informed through e-mail. An order will, however, in principle, always be sent within 4 business days after receipt of the payment.
4.2 A delay in delivery does not entitle the customer to compensation of any damages, or annulment of the contract or non-fulfilment of any obligation imposed on him from this or any other related agreement.
4.3 We do our utmost to maintain the website as up to date as possible. We however cannot avoid that unexpectedly a product is sold out. In this case we will contact you within one business day.

Article 5. Warranty and returns
5.1 We do our very best to deliver a perfect product. Should the article nevertheless not meet your expectations, you can submit a return within 14 days after receipt of the order, on our website.
5.2 We will solve any problems as soon as possible (normally within three working days). If the solution does not meet your expectations you can cancel the order, without additional costs. The amount already paid will be refunded within 3 working days after the article is received back by us. Refunds will be done via your bank account. This warranty is not applicable when the product has been used, scratched or damaged.
5.3 If you for whatever reason do not wish to keep the product, you have the right to return the product within 14 days after shipping, to Bricks 86. Returns are only accepted if the product packaging is intact and the product is not used. The return is to be reported to Bricks 86 prior to shipping. After which our shipping address will be provided. The cost of return shipping are for the client’s account .
Bricks 86 will, within 3 business days after receipt of the product in good condition, refund the amount paid directly to your bank account (if you paid by “iDEAL” or bank transfer), or to your credit card company. In both cases after retention of the charged original shipping costs (the (international) shipping fee paid).

Article 6. Liability
6.1 Any liability of Bricks 86, its staff or owner and the products of Bricks 86, for all damages of any kind, directly or indirectly, including loss of profits, consequential damage to movable or immovable property or to any person, is specifically excluded. Bricks 86 cannot be held liable for damage caused by the implementation of the agreement by third parties.
6.2 Bricks 86, its staff or owner assumes no liability for any damage arising from the use of the products of Bricks 86.
6.3 Any liability of Bricks 86 towards buyer cannot in any case exceed the invoiced amount that the buyer under the agreement relating to Bricks 86 is due.

Article 7. Force majeure
7.1 Bricks 86 has, in case of a force majeure, the right, at its opinion, to suspend or terminate the contract without judicial intervention. Bricks 86 will inform the client in writing. In this case Bricks 86 is not obliged to any compensation, unless standards of reasonableness and fairness determine otherwise.
7.2 Force majeure means any deficiency that cannot be blamed on Bricks 86, because it is not due to its fault. Neither under Dutch law, nor based on generally accepted practice.

Article 8. Privacy
8.1 Bricks 86 skateboards (“us”, “we”, or “our”) operates the bricks86.com website (the “Service”). This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.
8.2 We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible from bricks86.com
8.3 We collect several different types of information for various purposes to provide and improve our Service to you. All personal data disclosed to Bricks 86 will only be used for the handling of the order and will never be made available to third parties. Bricks 86 does not receive or store any bank account or credit card information on its computers.
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

If you are located outside The Netherlands and choose to provide information to us, please note that we transfer the data, including Personal Data, to Netherlands and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
8.6 Bricks 86 skateboards will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.
8.7 Bricks 86 skateboards may disclose your Personal Data in the good faith belief that such action is necessary to:

-To protect and defend the rights or property of Bricks 86 skateboards
-To prevent or investigate possible wrongdoing in connection with the Service
-To protect the personal safety of users of the Service or the public

8.8 The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
8.9 We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
8.10 Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
8.11 Children’s Privacy: Our Service does not address anyone under the age of 18 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.
8.12 We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “effective date” at the bottom of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Article 9. Various
9.1 If you provide Bricks 86 in writing with an address, Bricks 86 is entitled to use that address for shipping of orders, unless and until you inform Bricks 86 in writing of another address to which your orders should be sent.
9.2 When Bricks 86, over a shorter or longer period of time, whether or not implied, applies the conditions less strict, this does not exclude stricter compliance with these conditions on a later date.
9.3 If one or more of the articles of these conditions or any other agreement with Bricks 86 is contrary to any applicable legal provision, the article is skipped and will be replaced by Bricks 86 by a new legally permissible comparable provision.

Article 10. Applicable law and jurisdiction
10.1 On all rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, only Dutch law applies.
10.2 All disputes between parties will only be submitted to the competent court in the Netherlands.

11.1 By using the Bricks 86 website (bricks86.com and bricks86.nl), you signify your acceptance of the terms stated above. This site contains links to other sites. Bricks 86 is not responsible for the privacy practices or the content of the adjoined websites.
11.2 Bricks 86 may set and access cookies on your computer. If you don’t want any cookies, your web browser likely includes an option that allows you to turn them off, but, if you don’t accept them, some portions of the site may not function properly.
11.3 If you are interested in receiving news and special offers from Bricks 86, we request that you join our email list. The Bricks 86 email list is used to send you information about Bricks 86, including new releases, web-exclusive sales and new publications. We do not sell, rent, or share our email list. Please join our email list by clicking on “subscribe to newsletter” on the Bricks 86 homepage. In the event you wish to update or delete an email address in our possession at any time for any reason, you can do so by logging in to your account on Mailchimp.com, changing your personal information.
